NIL vs. revenue sharing: two parts of college athlete compensation

Start with the source of the payment, then read the terms governing it.

The key distinction

Third-party NIL and institutional revenue sharing involve different sources of compensation. In the first, an outside commercial relationship is central. In the second, a school’s compensation arrangement is central. Treating every payment as an ordinary brand deal makes the structure harder to understand.

The IRS’s NIL overview explains that the House settlement allows Division I programs to share revenue directly while private NIL arrangements continue. This does not mean every athlete receives a payment or that every school’s arrangement is identical.

What changed in the landscape

The NCAA’s June 6, 2025 statement describes final court approval of the House settlement as a new phase for Division I athletics and discusses the defendant conferences’ administration and enforcement role. That historical milestone helps explain why older articles can describe a different system.

When reading an explainer, check whether it predates the settlement, describes a proposal, or reflects an implemented rule. ‘Could allow’ and ‘now allows’ are not interchangeable. This page intentionally avoids presenting an old annual cap as a permanent current figure.

Questions athletes and families should ask

Request a clear explanation of total compensation, dates, conditions, rights, and the process for changes. Ask how the proposed arrangement relates to other commitments. Do not assume that an external brand can use school marks or that an institutional agreement answers questions about a separate endorsement.

If a transfer, injury, roster change, or schedule disruption occurs, bring the actual agreement to the appropriate adviser. General internet descriptions cannot determine the effect of those events on an individual contract.

Keep the categories separate in your records

Use separate entries for each agreement and payer. Track promised amounts and received amounts independently. When comparing opportunities, match time periods and definitions; an annual figure and a multi-year maximum are not directly comparable.

Read who pays NIL money for the participants around a deal, then valuations versus earnings for interpreting public figures. For personal decisions, verify current institutional and governing-body guidance. This article is general education, not legal or eligibility advice.
